I don't like to inform you. But i got bad news.

Marina died. A sad story. A "hirap" life ended, 

maybe because of this difficult Covid19 area. 

May God open his hands and welcomes her.

I met Marina several times in an outside Muntinlupa Prison. I could accompaign her a little bit with her housing, she got a new door with a locker, some clothes, bedding, a handy and we just spoke a lot together about her difficult life. I will keep her in my heart as  my lovely, smiling kaibigan.  Love Gabi

Lovely  children are living next to her simple room, and there was happiness, laughing around. As one of my gifts, I brought a box of Swiss chocolate, it seams that she whants to make a good advertisement. She told me about the difficulties to visit Christian, her housing and and and ...

Many organizations and human rights advocates are once again challenged as the proposals to lower
the age of criminal responsibility is being considered in Congress. As of August 2016, constitutional
amendments to Republic Act No. 9344 have been filed lowering the minimum age of criminal
responsibility (MACR) from 15 years old to 9 years old.
We ask questions: Is this bill a reaction to criminal groups using children as their pawns in the enactment
of a crime? Is the bill to lower the age of criminal liability aimed at dissuading criminals to use children?
What is the purpose of this bill?
Lowering the minimum age of criminal responsibility will have not deter criminal minds from using or
forcing children to do the criminal acts. Lowering the minimum age of criminal liability will not increase
security among citizens. Lowering the minimum age of criminal liability will just embolden or taunt
criminals as they do not have any concern for the innocent young minds.
Let us be aware that children as low as 9 years old as still being formed. They are still being taught
about what is right and wrong, about the complexity of society, about their rights and responsibilities.
Even though they are being taught, the fact is people use them for their innocence; the fact is the
children are being misguided and forced to do criminal things by people who should know better. Why
imprison the children? Prisons are not places for children. To lock them up in adult prisons is to
condemn them to torture, sexual violence and solitude. 1 What does this intend to do? Is it not our
responsibility as adults to form our children and not judge them, to love them and not to hate them, and
to care for them and not to penalize them?
As we can see clearly that the criminal justice system in the Philippines, characterized by very poor and
inadequate facilities, inhumane conditions, inefficient handling and resolution of cases, among others,
has often failed for adult offenders and more so for children who have come into conflict with the law
(CICL). These children, who are likely to have experienced abuse and neglect in their own homes and in
their immediate environments, are now forced into harsh and dehumanizing situations within the adult
criminal justice system that expose them to further abuse and tarnish any hope for them to be
reintegrated into their families and communities and become responsible and productive citizens. 2
Even before arrest (Amnesty 2003), children who come into conflict with the law tend to represent the
most disadvantaged and marginalized sectors of society. Many are fleeing difficult home situations,
often exacerbated by abuse and poverty and resulting in an interrupted education.
We need to stop making children criminals. We need to assert the rights of every human being below
the age of 18 years. Criminalizing children causes persisting harm not only to the overall development of

many children but also of human societies. It encourages a spiral downwards by children into further
offending and increasingly violent offending which often extends into adulthood. It prevents societies
moving on by upholding lingering beliefs in original sin and the need to beat the devil out of children.3
The Philippine Jesuit Prison Service Foundation, Inc. (PJPSFI) opposes the proposal to lowering the
MACR. Instead, we strongly call for the strengthening the 4pillars of justice system and develop support
systems for children that will facilitate the reintegration of former CICL and prevention of offending or
re-offending.
This comes in the form of peer support groups—former CICL trained to become peer facilitators who
can reach out to other children at risk of offending in the communities. Adult volunteers from the
different communities provide the children with another level of support—monitoring of the progress of
former CICL who have been reintegrated into their families and communities, and awareness-raising
activities among parents and other significant adults on child rights and children’s justice issues.
Children’s justice committees composed of barangay officials, members of the lupong tagapamayapa
(village justice committee), community volunteers and other stakeholders conduct mediation sessions
and diversion.
In all decisions taken within the context of the administration of juvenile justice, the best interests of the
child should be a primary consideration. Children differ from adults in their physical and psychological
development, and their emotional and educational needs. Such differences constitute the basis for the
lesser culpability of children in conflict with the law. These and other differences are the reasons for a
separate juvenile justice system and require a different treatment for children. The protection of the
best interests of the child means, for instance, that the traditional objectives of criminal justice, such as
repression/retribution, must give way to rehabilitation and restorative justice objectives in dealing with
child offenders. This can be done in concert with attention to effective public safety.5

- 10min. mit dem Tricycle zurückfahren, durch Bananenplantagen, Geissen und Kühen, entlang der grossen Mauer vom Maximum Gefängnis

- Ausweis, Geld, Lesebrille, Desinfektionsmittel, Babypuder und das GefängnisSchulMaterial dabei ???

- träumen von ....

Knast:

Lächelnde Menschen, schäkern mit den Staatsangestellten, kein Verkehr, Palmen, spazieren unter dem Regenschirm mit einem Mörder,  Gedränge bei allen Spendeaktionen, miserable unhygienische Unterkünfte, vitaminloses Essen, Malen und Meditieren, in der Kirche den ganzen Tag ein schattiges Plätzen besetzen, dazu Singen, Beten und Klagen, lachen, die Kranken im Spital auf blossen Kartons oder Eisengestellen,  Tennis, Basketball, Frisbee. Geld, Schulden - Zinsen - es herrscht immer der Reichere und Stärkere! Marktstände mit frischem Gemüse, Fleisch, lebende Schweine... Coca Cola ... Bier - nein das gibt doch nicht so offiziell! Ein "Hallo Hallo" Mix-Dessert spendiert bekommen von den Inmate Lehrern! ohh  ... fast hätte ichs vergessen DAS IST DER KNAST! 

Und:

Ich habe selten soooooo  viel Geduld und Zuversicht, Vertrauen, Gottes Geist, gespürt,

doch auch Hilflosigkeit, Armut, Ungerechtigkeit und Frust, gespürt,

Jeder findet einen kleinen Platz, ist in die Hierarchie hineingepfercht und muss sozial funktionieren! Draussen  wie drinnen kämpfen sie um jeden Peso und wollen ihre Familie unterstützen. 

Jeden Morgen aufstehen, Lippenstift drauf, sich strecken, umfallen und aufrappeln, lächeln, jeden Tag.

Paradies:

Lächelnde Menschen, Palmen, ein Jahr lang Sommer, heiss, schwül, Luftventilator oder Air-Condition, sonnig o heftiger Regen, Babypuder und Desinfektionsspray, ein unereichbarer Mangobaum vor dem Schlafzimmerfenster, stinkender Abfall, verbotene Durian Frucht, süsse Ananas, bellende Hunde, krähende Güggel, lautsprecherverstärktes Karaoke Singen, 3 Std. für 20km ans Meer, Verkehrschaos, ein Buco Juice geniessen, süsse Spaghetti, steile Vulkanberge und Reisterrassen mit Kohl u Karotten, Hütten und Strassenkinder, Bettler, 5Stern Hotels, wöchentliche Massage, Air Condition in allen Shopping Center, Muscheln, Steine, immer warmes Wasser!

Wer ist warum im Gefängnis?

Meine Begegnungen mit Männern im Nationalgefängnis New Bilibid: 

Ich habe Schulunterricht bei Jugendlichen und ALS (Geografie mit weltweiten Festen und Kulinarischem Austausch, Yoga, Volleyball, Frisbee) gegeben, Meditiert, Religions- Erlebnisstunden geteilt - Hilfsaktionen unterstützt, Essen verteilt, Arztuntersuchungen begleitet, Schulklassen einen Einblick ermöglicht, gemalt, gelacht und getröstet...und gebetet. 

Während 12 Monaten habe ich jeweils  4x pro Woche, die 4 Gefängnisse besucht.

Mit einigen Männern, Bedingung Englisch sprechend, ist eine herzliche Beziehung entstanden, andere haben das Vorlageblatt selber ausgefüllt. So möchte ich Euch einige Interview aufzeigen und euch eintauchen lassen in die Welt des Knast's: 

Jean-Marie Z., Schweizer, aus Pully (VD), geb. 16. Aug. 1951. Beruf Chemist.

N201P-2593 – verhaftet 1983/1996, seit 1999 im Max. Prison. Verurteilt wegen Totschlag und Drogen (Heroin, LSD) – mehrere Verurteilungen, lebenslänglich.

Ich habe Zolla kennengelernt im Max. Gefängnis, Frühling 2016. Bei meiner freien Gesprächszeit zwischen den Meditationen, kam er zu Christian und mir! Zuerst war er gar nicht interessiert, als Welschschweizer spricht er fast kein Deutsch und ich schlecht Französisch, so fanden wir uns im English wieder! Er ist ein aufgeweckter Mann, der seine Meinung sagt und klar bei Verstand ist. Er spricht perfekt Tagallo, übersetzt für den Bucor Priester, Msgr. Olaegar, Texte in Englisch-Tagallo. Leider hat er bis auf Einen, alle Zähne verloren (ziehen müssen)!

1966, mit 16 Jahren, verliess er die Schweiz, reiste über Afghanistan (11Tage in Gefangenschaft) nach Asien, Ceylon – Nepal, India – Burma. Seit 1974 hat er eine permanente Aufenthaltsbewilliging in den Philippinen. Er lebte in Manila, Ermita, führte dort eine Bar.

Seit 1983 kam er immer wieder mit dem Gesetz in Konflikt, Drogenhandel. Verschiedene Verurteilungen, Anwälte, Geldzahlungen, ein Richter wurde pensioniert, Freilassung. 1991 Wiederaufnahme der Fälle, innerhalb von 2 Wochen wurde er zu lebenslänglich verurteilt, er bekam keine Meldung davon. Seit 1999 im Max. Gefängnis, 2002 dachte er, dass er freikommt, dann der Hammer, das war 2006, Lebenslänglich! Er sieht seine Verfehlungen mit Drogen ein, hat sich an das beschränkte Leben hier gewöhnt und kann die Vorteile gegenüber europ. Gefängnissen sehen.

Jean-Marie hat 2 Kinder (42 und 31 Jahre) von seiner ersten Frau.  Im Max. Gefängnis hat er eine Filippina geheiratet und ist glücklich, zufrieden. Das bedeutet nämlich auch, dass er fast täglichen Besuch hat und Waren, wie Essen, bestellen kann.

Kontakte ausserhalb hat er nur durch die Schweizer Botschaft, die sich 1-2mal jährlich bei ihm meldet. Monatlich bekommt Jean-Marie ein Sozialhilfegeld von ca PH 6500.— = Fr. 125.—und kann weitere Anträge stellen.

Seine Hoffnung:

Dass er bald entlassen wird. Jetzt ist er bereits 24 Jahre seines Lebens in Gefangenschaft. Seine Frau! Er lebt und erweitert sein Wissen, seine Spiritualtät (mit Tarot oder Book of chance).

Seine Wünsche:

Survive – serve people – stay alive! Life is really very hard!

Please tell me about your life, livelihood, before prison:

Province Sorsogon – MT.MAYON. I am (indefinite leave) elementary teacher, an artist, a photographer, a family man and happy living with two children and two grandchildren.

What happened, that you are in prison? My case was lifted to court as decided by the party (con-

Plainant) the local arrangement was not successful after 3 dialogues court hearing from 2002 to 2013, the verdict. I was on appeal status but I withdrawal it after a year.

How is it to live inside prison?

Being trained as boy scout I should adapt on my environment. Selt congerted inmeter, food  with junkie not used to eat .. warm temperature at our cell. Luckily for me that Iam an RDC teacher, part of therefore a bit privileges for us.

What is difficult? Financial, communication with family, time, deal people to follow up my …

What is your hope – your chance?

To recognize POS Documents section my ‘ to be served simultanerably” on my sentence.

What else do you want to say?

 If God closes a door for you, he would open another door for you in a right time.  

--> Escobedo hat mir sehr geholfen beim übersetzen und im Geografie Projekt Weltkarte mit Spiel kreieren. Ich habe seine Frau Minda besucht und und sein Schulzimmer mit den Kunstwerken (Bildern) bewundert.

       Since when are you in jail / prison?  September 13, 2013

Please tell me about your life, livelihood, before prison: Marikina, Manila. I was working overseas as a Hotel Manager in Malaysia. I do have a busy life, doing my job. Unfortunately I got myself in prison.

What happened, that you are in prison? The reason that I am in prison now is because I commit a crime at my younger age, doing those stupid things with the influence of my friends back in my home town.

How is it to live inside prison?

On my first day, month and year in prison it was quite hard to accept that I am in prison, but I set my mind that this is all God’s willing. I am now a inmate ALS teacher, I conduct a Sari Sari Store for Bucor, Mam . 

What is difficult? It’s very difficult when you used to have a good life, then all -  in a sudden blink of en eye - all is gone.

What is your hope – your chance? I don’t loose hope because I know and I believe God give me this kind of situation that I can’t bare and to accomplish.

What else do you want to say? People shouldn’t loose hope whenever they have a problem that they think it’s too difficult to achieve the price of a better life. Try and try until you succeed.

Please tell me about your life, livelihood, before prison:

Ilocos is my home town, parents still there. I was married, have 3 children (2 are studying in London, living by my sister, a Dr. ) from 2 woman’s,  separated during prison time, now I have a girl friend. In In Malate, Manila was my Office, I was owner of Travel & Tour Co.

What happened, that you are in prison? The owner of my travel business cheated (deceit/swindling)  before me. I had a private lawyer, 8cases against me, 7 cases dismiss. syndicated, Money more then 150Mio.PHP. Last case a plea guilty. I don’t know these peoples. I got arrested at Nino Aquino Airport. MNL. City jail – NBA motion to Manila City- Provincel jail Bicol, hearing. Arrive in RDC Feb. 2011. Now I am inmate teacher ALS, coordingator STPYO.

How is it to live inside prison?

6h counting, breakfast, therapy with juvenile community program MO-FR, 11.30 private lunch in ALS, teaching in ALS Mo-Sat, for RVO on Sat+Sunday, GO Inside cell, 6pm, dinner, shower, check my review of day, sometimes movie, DVD.

What is difficult? Separated life, separated from wife. Very hot, bad bogs! Mental problems, hope for … missing of… daughter, friends. Being a inmate, no freedom. Only Church – school – cell = so limited my life!

What is your hope – your chance? As inmate teacher I can assist a have a lot of interest, a big  help is for me the catholic church, Fr. Eli is mentoring. I hope to have a small business again!

What else do you want to say? I suffered a very difficult life here, that’s not the reason to make my life destructed, that the beginning, that’s my strength, to reach my good condition of life.


Bragas ist der gute  "Tätschmeister" im RDC. Er weiss alles! Ich habe seine Autorität bewundert,  er  ist/war zuständig für die Zelle der ca. 50 Jugendlichen, hat sie mit Wettbewerben motiviert und mit Geld persönlich unterstützt. Seine Freundin Krislyne habe ich im RDC kennengelernt und dann in Baguio besucht. Eine tolle Freundschaft!
